What is a Short Sale? 
A Short Sale is the sale of a home when the net proceeds do not fully pay off the existing mortgage loan(s) and the Mortgage Servicer is willing to accept a discounted payoff. The closing costs that are typically paid by the Seller are paid out of the proceeds from the sale, including but not limited to, commissions, escrow and title fees and any negotiated Buyer’s cost. Your home is sold and you avoid foreclosure.

Why would any Mortgage Servicer accept less than what is owed on a mortgage? 
Mortgage Servicers are in business to lend money, not to own real estate. They do not want the expense of the foreclosure process and/or the holding and maintaining of the property if it does not sell at foreclosure. The foreclosure process is very expensive and time consuming, so many lenders will agree to what seems a loss on the mortgage when they will actually save money by not completing the foreclosure and holding the property in their portfolio.

If I do a Short Sale, how much will I have to pay to sell my home? 
In most cases, you will not pay any sales costs if your Mortgage Servicer approves the Short Sale. All commissions, title and escrow fees, and some repair expenses are paid by the Mortgage Servicer, Investor or Mortgage Insurance company, if applicable, as part of the Short Sale approval.

What sort of hardship would my lender consider legitimate? 
To some extent, that will depend upon the Mortgage Servicer considering your Short Sale request. Below you will find a list of common “hardships” that may be accepted by Mortgage Servicers:
  • Family illness or injury
  • Job relocation
  • Job loss or significant income loss
  • Divorce or split of domestic partners
  • Death of a spouse
  • Adjustment in mortgage payment or unforeseen increase in living expenses
  • Too much debt
  • Military service
Do lenders approve all Short Sales? 
No. That is why it is critical to work with someone, who has extensive experience at getting Short Sales approved and has direct contact with Mortgage Servicers.

I have a second mortgage on my property, so can I still do a Short Sale?
Yes. it is possible and common to work with the Mortgage Servicer that holds the second mortgage, (many times the same Mortgage Servicer holds the 1st and the 2nd loans) to put together a Short Sale transaction. It is very important however, that you let your Real Estate agent know if you have a second mortgage, home equity line of credit (HELOC), or any type of lien against your property such as a Home Owners Association lien, tax lien or mechanics lien. ·

My property is in rough shape and needs work; can I still do a Short Sale? 
Absolutely, Mortgage Servicers often take into consideration repair costs, as a factor, when determining whether to approve a Short Sale offer.

I am concerned about my credit, so how will a Short Sale affect my credit?
The goal in a short sale to avoid foreclosure. Consult your attorney to verify how this may affect your credit.

Can I receive cash from a Short Sale? 
No, the Short Sale is only designed to get you out of your mortgage debt rather than going through the entire foreclosure process. It is not a refinance option and you will be vacating the property, as you would, if you were going through foreclosure. However, there are particular government programs, depending on several factors, that you may or may not qualify to participate in that are designed provide limited cash to offset moving expenses and/or rental down payments. These programs would need to be discussed with your lender at the time the short sale was initiated.

What if my home is not worth what I purchased it for? 
This is the typical scenario for a short sale, when you can only sale it for less than it is currently worth. · What if I have filed bankruptcy? You will need to check with your Bankruptcy Attorney to verify if you can proceed with a Short Sale.

A "Short Sale" is a sale of real estate in which the sale proceeds fall short of the balance owed on the property's loan. It often occurs when a borrower cannot pay the loan on their property, but the lender decides that selling the property at a moderate lodd is better than pressing the current debtor. Both parties consent to the short sale process, because it allows them to avoid foreclosure, when then involves hefty fees for the bank and poorer credit report outcomes for the borrower.

A foreclosure is the legal process by which an owner's right to the property is terminated, ususally due to default. This typically involves a forced sale of the property at public auction, with the proceeds being applied to the debt.

Forclosures or short sale are indeed going to affect the market value of neighboring homes in one way or another. Whenever a house sells in neighborhood, the amount at which the house is sold is noted and has an effect on general housing prices within the same locality. If your neighboring house is facing short sale or foreclosure, then the house sells for much less than it would have if it hadn't gone into foreclosure. Additionally, if that foreclosed house is similar to yours in size and attributes then this can depreciate the market value of your house.

The same is true when people sell their homes for less than the homes are actually worth because they just want to get rid of the loan. Every real estate transaction in your neighborhood has the potential to bring up or bring down the market value of your home. Every real estate market is different. Your real estate professional's main goal is to get you the best price in any martket.

“Why should a seller go through the short sale process rather than letting their house be foreclosed upon?”

While we cannot speak to every client circumstance, we can say one thing with complete conviction.  In almost all instances in which a potential seller is contemplating whether they should short sell their house or let it go through the foreclosure process, a short sale is the better option. The following are examples to consider:

Example A - Short Sale
Mr. Smith owns a home in which he has a mortgage balance of $220,000 and a current market value of $150,000. Mr. Smith has elected to short sell his property. His Realtor successfully obtains a buyer who puts forth an offer price of $120,000 (80% current market value according to Realty Trac Foreclosure Report 5/26/2011). After reviewing the buyers offer and the financial hardship information from Mr. Smith, Mr Smith’s bank agrees to accept the short payoff of $120,000 which would leave a deficiency balance of $100,000.

The transaction closes and is final.  Mr. Smith then pulls his credit report 30 days after the transaction takes place. On the report he notices that the mortgage trade line states “Mortgage debt was settled for less than full” and the balance on the mortgage is $0.  Mr. Smith is now on the road to financial recovery.

Example B - Foreclosure
For the ease of illustration we will use the same value and mortgage debt amounts as in Example A. However, Mr. Smith has elected to forgo the short sale process and let the bank foreclose on the property.  The bank holding his mortgage facilitates the proper legal procedures to foreclose on the property, all of which are costly.  Mr. Smith is notified and his property foreclosed upon of which is taken back by the bank to sell as an REO.

Six months later, the bank finally sells Mr. Smith’s home only they sell it for $90,000 (60% of current market value according to Realty Trac Foreclosure report dated 5/26/2011). Remember, as a short sale, the home would have sold for $120,000 keeping the deficiency to $100,000. In addition to the deficiency now being $130,000, the bank has elected to add on legal costs of $15,000 and asset preservation costs of another $5000 for a total deficiency liability of $150,000. Mr. Smith pulls his credit report 30 days after being notified that the bank has sold his property and of his liability.

On the report he notices that the mortgage trade line states “Foreclosure” and the balance is $150,000. Because of Mr Smith’s choice to choose foreclosure vs. short sale his road to financial recovery has taken a major detour. He not only has a foreclosure on his credit report but now has a much larger deficiency balance in which the bank, in most cases, will report on his credit report as a balance owed.

The Best Option is Clear
While the financial and credit advantages are clear when choosing a short sale over a foreclosure, other advantages are sometimes overlooked. The most important of all of them is maintaining the seller’s dignity and peace of mind. We have heard too many stories of families having to leave their homes because of a Sheriff’s order or some other type of legal action. The short sale process alleviates this negative social impact. The process puts the control back in the seller’s hands so that they can get back on the road to financial recovery and start providing for their families. In the battle of the two evils, a short sale always wins!!!

Home Affordable Foreclosure Alternatives (HAFA) Program

If you can't afford your mortgage payment and it's time for you to transition to more affordable housing, the Home Affordable Foreclosure Alternatives (HAFA) program is designed for you. HAFA provides two options for transitioning out of your mortgage: a short sale or a Deed-in-Lieu (DIL) of foreclosure. In a short sale, the mortgage company lets you sell your house for an amount that falls "short" of the amount you still owe. In a DIL, the mortgage company lets you give the title back, transferring ownership back to them.

In either case, HAFA offers benefits that make the transition as favorable as possible:
  • Unlike conventional short sales, a HAFA short sale completely releases you from your mortgage debt after selling the property. This means you will no longer be responsible for the amount that falls "short" of the amount you still owe. The deficiency is guaranteed to be waived by the servicer.
  • In a HAFA short sale, your mortgage company works with you to determine an acceptable sale price.
  • HAFA has a less negative effect on your credit score than foreclosure or conventional short sales.
  • When you close, HAFA provides $3,000 in relocation assistance.
You may be eligible for HAFA if you meet all of the following criteria:
  • You live in the home or have lived there within the last 12 months.
  • You have a documented financial hardship.
  • You have not purchased a new house within the last 12 months.
  • Your first mortgage is less than $729,750.
  • You obtained your mortgage on or before January 1, 2009.
  • You must not have been convicted within the last 10 years of felony larceny, theft, fraud, forgery, money laundering or tax evasion in connection with a mortgage or real estate transaction.
  • HAFA is available for mortgages that are owned or guaranteed by Fannie Mae and Freddie Mac

Bank of America offers relo assistance to short-sellers

Delinquent borrowers must obtain preapproved short-sale price from bank

Bank of America says it will provide up to $30,000 in relocation assistance to delinquent borrowers who work with the bank to obtain a preapproved short-sale price before submitting purchase offers.

Short sales must be initiated by the end of this year and close by Sept. 26, 2013, to be eligible for the payments, which will range from $2,500 to $30,000 at the completion of a qualifying short sale. Payments will be determined on a case-by-case basis using a calculation that includes the value of the home, amount owed and other considerations, Bank of America said in announcing the program.

The program -- based on a similar incentive offer Bank of America tested last year in Florida -- will be available nationally. But Bank of America anticipates the greatest response will come from borrowers in California, Nevada, Arizona, Florida, and other states hit hardest by the economic downturn and falling property values.

Customers who believe they may be eligible for Bank of America's short-sale relocation assistance program may contact program specialists at (877) 459-2852. Qualifying short sales that have already started but have not closed may be eligible for the program.

Bank of America says its short-sale initiatives have generated 200,000 short sales in the last two years and another 30,000 in the first three months of this year.

Last month, Bank of America announced it was shortening decision times on short-sale offers to 20 days, down from 45 days or longer.

5 Things to Know about Buying A House at A Golf Course

The idea of life on a golf course is a dream to many prospective homebuyers. Through each window, a golf course can create lush picture-perfect views of vast, meticulously maintained lawns. In fact, in many neighborhoods and towns, golf course homes offer the best vistas available. Another benefit is that houses are often sited so that neighbors are not directly visible, and all views face the fairway. Best of all, for avid golfers, owning a house at a golf course means that their next round of play is right outside.
In home buying, what seems ideal seldom is. It’s important to consider the pros and cons of living next to a golf course, especially if you’ve never lived on a course. Here are the top five things to keep in mind when hunting for your golf course home:

1. Courses are maintained, early and often. Lawns must be cut and tended to in the morning, before rounds are played. That means that groundskeepers are out on the course before sunrise. In places with a year-round golf season, putting greens are usually maintained every day. If a master bedroom window faces a green, headlights from golf carts and riding mowers will blaze through. The engine noises will be heard as well.

The fix: If you’re a sound sleeper, no worries. If you’re a light sleeper, make sure that your home is located on a fairway and relatively distant from greens and tee boxes that require more maintenance. Select a property that positions your master bedroom away from the course or look for window treatments such as blackout curtains. You may even want to consider investing in a white noise machine.

2. Pay attention to location of cart paths when house hunting. Many courses built in residential developments are lined on both sides by houses. The path for golf carts will run along one side of the fairway from tee box to green. If a cart path is directly behind a home, golf carts will be zipping by all day. This can be more than a little disruptive to the otherwise serene setting a golf course affords.
The fix: Proximity to a cart path does affect housing lot desirability and this should be reflected in the price of a home. Sometimes a house in one of these “high-traffic areas” will be a great deal. Good landscaping can block out some disturbance, but will also block views from the ground level. Smart positioning of outdoor features like decks, pools, hot tubs and other water features is a must to minimize the disruption of carts zooming by.

3. Tee boxes and greens are regular stopping points. Every golfer will park his or her cart at every tee box and putting green during a round of play. If a house is located near these course elements, players will be stopping near your home throughout the day. Their chatting and laughter will be audible, and their loud golf pants will be visible. If a house is on a cart path near a tee box or green, carts will park on the path regularly.
The fix: Where there’s a golf course, there are golfers. This will always be true. So when viewing a house at a golf course, always sit out back or facing the course and wait for a foursome to play through. Take note of where they park their carts and how much noise they make while playing. If you’re not comfortable with the noise and motion of the golfers, then the house is not for you.

4. Understand all of the deed restrictions. One of the potential cons of living next to a golf course is that homes are almost always in deed-restricted communities where certain aspects of home maintenance and modification are regulated by a homeowners’ association (HOA). In order to maintain a certain look and feel of the course, house exterior paint colors usually need to be selected from a limited palette. You probably can’t put a swing set in your backyard, facing the course. Landscaping requirements may mandate that a certain density of trees be planted on your property and which species are acceptable – this may seem un-American, but it is rather common. In golf course communities, homeowners tend to have visible pride of ownership and take these rules very seriously. Golfers who can see your house from the course may complain to the community or HOA if they notice that you’re behind on maintenance.
The fix: If you like the feel of a neighborhood, aspects of the deed restrictions probably appeal to you. It means that many qualities of the neighborhood will be retained for years. Always request the HOA documents and read through them when contemplating the purchase of a golf course house that is part of a deed-restricted community. These documents are often available online. If the rules don’t work for you, look elsewhere.

5. Golf course land is often off-limits for non-golf activities. Golf courses are great for playing golf, but can’t be used for much else. Recreational walking or biking on cart paths is forbidden at almost all courses. You can’t walk your dog along a fairway.
The fix: If you like to walk or bike, make sure that a golf course community also serves these needs as well. Even if you live on a golf course, you won’t play every day, and your golf course home should meet the needs of a well-balanced life.
There’s no question that having a house at golf course provides a great quality of life for many people. If you think a golf course home might be right for you, just remember to weigh the pros and cons and carefully research specific properties before taking the leap into homeownership. Then you can enjoy all the perks of living next to golf course views.

Housing struggles in two Chandler ZIP codes

Two Chandler ZIP codes continue to log more distressed properties than any others in the Southeast Valley, according to the latest Arizona Regional Multiple Listing distressed-properties report that tracks short sales and foreclosure listings.

Area real-estate experts say that the housing market is recovering, however, and that the Chandler numbers aren't as bad as they appear.

"The situation is improving steadily and we're way past the worst, which was 2009," said Mike Orr, a Mesa housing-market analyst and founder of the Cromford Report. "Far fewer homes are in foreclosure."

The geographic breakdown of distressed properties does not present a true picture because Chandler ZIP codes cover larger areas with higher housing densities than those in neighboring communities, according to Orr.

"Chandler has relatively large ZIP codes," Orr said.

That could be why the central city 85225 has 199 short sales and foreclosures on the market and southeast Chandler's 85249 has 177, more than any others in the region. Several ZIP codes in Mesa, Tempe and Gilbert have more than 100 distressed properties on the market.

However, those numbers are lower than those reported last month, and Chandler's 85225 no longer is among the Valley's top five spots for distressed properties. The five are now heavily concentrated in the Valley fringes and include parts of Laveen, Surprise, Goodyear, Buckeye and Anthem. At the top is Maricopa's 85138 ZIP code, which has 233 short sales and foreclosures on the market.

Bob Behm, the listing service's CEO, said average home prices across the Valley have increased 4.6 percent since October, and homes are on the market for shorter time periods. However, he does not expect the prices will continue to climb at that rate because buyers are more cautious than they were before the recession and rapidly escalating housing costs "are what got us into trouble in the first place."

In another time, home prices would be climbing faster after a recession, according to Orr, especially given the rising demand and shrinking inventory.

"This is an unusual situation where perception trumps reality," Orr said. "There is a negative sentiment toward housing and people don't want to pay the higher prices, so they walk away."

Many of today's buyers are investors and winter visitors, said Chandler real-estate agent Pam Bernard.

"I have a steady stream of buyers from Canada looking for amazing deals," she said.

Investors are buying rentals, catering to a growing population of former homeowners displaced by foreclosures and short sales, she said.

The housing collapse has changed buying habits. More couples are using only one income to qualify for home loans just in case something happens to their jobs, and some potential buyers are holding off and renting for a couple of years just to see what happens, Bernard said.
